If you flexibly furlough employees this will need to be agreed with the employee or by collective agreement between the employer and a trade union. This needs to be done in a way that is consistent with employment, equality and discrimination law, that consent is valid for the purpose of claiming through the scheme.
Employees do not need to be placed on furlough or you can continue to fully furlough employees.
